1. Definitions
• “Company” refers to Gold Coast Leaflet Distributors.
• “Client” refers to any individual or business that engages our services.
• “Services” refers to flyer distribution, marketing, and related services provided by the Company.
2. Service Agreement
• All bookings for flyer distribution must be confirmed in writing via email or an official order form.
• The Company reserves the right to refuse any material deemed inappropriate or unlawful.
• Distribution dates are subject to availability and weather conditions.
3. Payment Terms
• Full payment must be made prior to distribution unless otherwise agreed in writing.
• Invoices must be paid within the agreed terms. Late payments may incur additional fees.
• No refunds will be provided once collation or distribution has commenced.
4. Distribution Policy
• The Company ensures that all reasonable efforts are made to distribute materials as per the agreed location and timeframe.
• Delivery Coverage: We make every effort to distribute flyers as widely as possible within the agreed area. However, we cannot guarantee delivery to every single mailbox due to access restrictions or unforeseen circumstances. In such cases, no refunds will be provided for undelivered flyers, as distribution efforts and resources will have already been allocated.
• Distribution Timing: While we aim to complete distribution within the agreed timeframe, delivery dates are approximate and may vary due to unforeseen circumstances.
• Weather Delays: Adverse weather conditions may cause distribution delays. We will resume services as soon as it is safe to do so to ensure your flyers are delivered without being damaged by rain or harsh weather.
• Results Disclaimer: We do not guarantee any specific outcomes or responses from flyer distribution.
• Distribution Area Changes: Any changes to the agreed distribution area require a minimum of 2 weeks’ notice. We cannot guarantee changes will be accommodated after this period, and additional fees may apply.
• Estimated Reach: Our estimated reach per area is based on our distribution maps, current delivery patterns, and, where possible, factors in ‘No junk mail’ letterboxes. Please note that this is an estimate, and we cannot guarantee the numbers due to fluctuations caused by construction and developments, inaccessibility, and other factors. Our distributors attempt to deliver to each mailbox within the designated area; however, we are unable to deliver to letterboxes marked with ‘No junk mail’ or similar signage. Any excess flyers that cannot be delivered will be disposed of or recycled by our team.
• Distribution Methods: Bulk distributions are delivered alongside other flyers, bundled together. This means multiple flyers are distributed as part of a larger group, and each recipient may receive several items within a delivery.
While individual distributions are typically delivered as single flyers, we cannot guarantee that they will always be delivered on their own. Given that we do not control when recipients check their mail or how many other flyers are distributed on the same day, it’s possible for multiple flyers to be present together in the same mailbox.
5. Client Responsibilities
• The Client is responsible for ensuring that all materials comply with Australian advertising laws and do not contain misleading or offensive content.
• The Client must provide distribution materials in the correct quantity and format as required.
• Flyer Quantity & Oversupply: It’s the client’s responsibility to provide the correct number of flyers. Any excess flyers will be disposed of or recycled unless otherwise agreed.
• Flyer Handling & Storage: We will take reasonable care when handling and storing your flyers. However, we are not responsible for damage or loss after flyers have been received or for wear and tear that may occur during distribution.
6. Cancellations & Rescheduling
• Cancellation Policy: A minimum of 2 weeks’ notice is required for bulk distribution cancellations. We cannot guarantee cancellations or changes after this period.
• Individual distribution cancellations made at least 48 hours before the scheduled distribution may be rescheduled, subject to availability.
• Cancellations made within 48 hours of the scheduled distribution may not be eligible for a refund.
7. Limitation of Liability
• The Company is not liable for damages or losses resulting from delays, distribution issues, or unforeseen circumstances.
• The Company does not guarantee specific customer responses or sales from leaflet distribution.
8. Privacy Policy
• Client information is kept confidential and used only for business purposes.
• No personal data is shared with third parties without consent, except where required by law.
9. Governing Law
These Terms and Conditions are governed by the laws of Queensland, Australia, including the Competition and Consumer Act 2010, Privacy Act 1988, and Environmental Protection Laws. Any disputes will be resolved in accordance with the laws of Queensland.
10. Amendments
Gold Coast Leaflet Distributors reserves the right to update these Terms and Conditions at any time. The latest version will be available on our website.
