1. Definitions
• “Company” refers to Gold Coast Leaflet Distributors.
• “Client” refers to any individual or business that engages our services.
• “Services” refers to flyer distribution, marketing, and related services provided by the Company.
2. Service Agreement
• All bookings for flyer distribution must be confirmed in writing via email or an official order form.
• The Company reserves the right to refuse any material deemed inappropriate or unlawful.
• Distribution dates are subject to availability and weather conditions.
3. Payment Terms
• Full payment must be made prior to distribution unless otherwise agreed in writing.
• Invoices must be paid within the agreed terms. Late payments may incur additional fees.
• No refunds will be provided once collation or distribution has commenced.
4. Distribution Policy
• The Company ensures that all reasonable efforts are made to distribute materials as per the agreed location and timeframe.
• Delivery Coverage:
We make every effort to distribute flyers as widely and thoroughly as possible within the agreed distribution area, aiming to maximise your campaign’s reach. However, due to factors such as access restrictions (e.g. gated complexes, locked mailboxes, “No Junk Mail” signage) and safety concerns for our distributors, we cannot guarantee delivery to every single mailbox within the area.
Additionally, weather interruptions, street or complex closures, safety incidents or other unforseen circumstances may impact full coverage despite our best efforts. As flyer distribution is a manual process carried out by people, there is the possibility of human error, or operational factors that may result in some flyers being delivered outside the intended area which can occasionally result in unintentional missed mailboxes during delivery.
In such cases, no refunds will be provided for undelivered flyers, as significant time, labour, and logistical resources will have already been allocated to your distribution. We encourage clients to view flyer distribution as a high-coverage marketing method rather than a guaranteed mailbox-by-mailbox service and to consider these potential limitations when planning your campaign.
• Distribution Timing: While we aim to complete distribution within the agreed timeframe, delivery dates are approximate and may vary due to unforeseen circumstances. All delivery dates provided are approximate and indicative only. As distributions are conducted alongside multiple campaigns and mapped runs, minor adjustments to delivery schedules may occur to ensure safe and efficient delivery. Delays do not constitute grounds for cancellation or refund and we recommend allowing flexibility in your campaign planning to accommodate potential timing variations.
• Weather Delays: Adverse weather conditions may cause distribution delays. We will resume services as soon as it is safe to do so to ensure your flyers are delivered without being damaged by rain or harsh weather.
• Results Disclaimer: We do not guarantee any specific outcomes or responses from flyer distribution.
• Distribution Area Changes: Any changes to the agreed distribution area require a minimum of 2 weeks’ notice. We cannot guarantee changes will be accommodated after this period, and additional fees may apply.
• Estimated Reach: Our estimated reach per area is based on our distribution maps, current delivery patterns, and, where possible, factors in ‘No junk mail’ letterboxes. Please note that this is an estimate, and we cannot guarantee the numbers due to fluctuations caused by construction and developments, inaccessibility, and other factors. Our distributors attempt to deliver to each mailbox within the designated area; however, we are unable to deliver to letterboxes marked with ‘No junk mail’ or similar signage. Any excess flyers that cannot be delivered will be disposed of or recycled by our team.
• Minimum Flyer Quantity: The minimum quantity per area for flyer distribution is 1,000 flyers. If a client provides fewer than 1,000 flyers for an area, the fee will still be charged at the equivalent rate for 1,000 flyers.
• Distribution Methods: Bulk distributions are delivered alongside other flyers, bundled together. This means multiple flyers are distributed as part of a larger group, and each recipient may receive several items within a delivery.
While individual distributions are typically delivered as single flyers, we cannot guarantee that they will always be delivered on their own. Given that we do not control when recipients check their mail or how many other flyers are distributed on the same day, it’s possible for multiple flyers to be present together in the same mailbox.
5. Client Responsibilities
• The Client is responsible for ensuring that all materials comply with Australian advertising laws and do not contain misleading or offensive content.
• The Client must provide distribution materials in the correct quantity and format as required.
• Flyer Quantity & Oversupply: It’s the client’s responsibility to provide the correct number of flyers. Any excess flyers will be disposed of or recycled unless otherwise agreed.
• Flyer Handling & Storage: We will take reasonable care when handling and storing your flyers. However, we are not responsible for damage or loss after flyers have been received or for wear and tear that may occur during distribution.
• Artwork and Printing Requirements: The Client is responsible for providing print-ready artwork that meets all necessary specifications for printing, including correct dimensions, bleed, crop marks, colour settings, and resolution. Gold Coast Leaflet Distributors does not accept responsibility for errors in the artwork provided by the Client, including but not limited to spelling mistakes, incorrect information, poor image quality, incorrect sizing, missing bleed, or crop marks. Files will be printed as supplied, and the Client accepts full responsibility for the final outcome of the printed materials. No refunds, reprints, or credits will be provided due to errors in artwork supplied by the Client.
6. Cancellations & Rescheduling
• Cancellation Policy: A minimum of 2 weeks’ notice is required for bulk distribution cancellations. We cannot guarantee cancellations or changes after this period.
• Individual distribution cancellations made at least 48 hours before the scheduled distribution may be rescheduled, subject to availability.
• Cancellations made within 48 hours of the scheduled distribution may not be eligible for a refund.
7. Limitation of Liability
• The Company is not liable for damages or losses resulting from delays, distribution issues, or unforeseen circumstances.
• The Company does not guarantee specific customer responses or sales from leaflet distribution.
Printing Costs Disclaimer:
Whether flyers are printed through Gold Coast Leaflet Distributors or provided by the Client via an external printing provider, the Client acknowledges that printing costs are separate from distribution services and are non-refundable under any circumstances. This includes, but is not limited to, situations where issues arise during distribution such as delivery errors, delivery to an incorrect area, timing delays, or campaign interruptions due to unforeseen circumstances. Printing and distribution are treated as separate services and costs, and the Client remains responsible for the cost of printing regardless of the distribution outcome.
8. Privacy Policy
• Client information is kept confidential and used only for business purposes.
• No personal data is shared with third parties without consent, except where required by law.
9. Governing Law
These Terms and Conditions are governed by the laws of Queensland, Australia, including the Competition and Consumer Act 2010, Privacy Act 1988, and Environmental Protection Laws. Any disputes will be resolved in accordance with the laws of Queensland.
10. Amendments
Gold Coast Leaflet Distributors reserves the right to update these Terms and Conditions at any time. The latest version will be available on our website.
